Terms of Service

These Terms of Service (“Terms”) govern your use of Picture Day OS (“Picture Day OS”, “we”, “us”), including picturedayos.com, the application, and studio pages hosted on our platform. By creating an account or using the service, you agree to these Terms.

If you use Picture Day OS on behalf of a studio or company, you represent that you are authorized to accept these Terms for that business.

Picture Day OS provides tools for photography studios: project and contact management, scheduling, contracts, invoicing, print sales, client portals, and AI assistants (“Kia”). Features available to you depend on your plan.

We may add, change, or discontinue features over time. If a change materially reduces the value of your paid plan, we will give reasonable notice.

You are responsible for keeping your sign-in credentials confidential and for everything that happens under your account.

You must provide accurate information and keep it up to date. Plan limits (such as the number of team logins) are enforced automatically and may not be circumvented.

You must be at least 18 years old to create an account.

You retain ownership of the content and data you add to Picture Day OS, including information about your clients. You grant us the limited rights needed to host, process, and display that data to operate the service.

You are responsible for having a lawful basis to collect and process your clients' personal information, for the accuracy of your own contracts, prices, and policies, and for complying with privacy, consumer, and tax laws that apply to your business.

You may not use the service to store or distribute unlawful content, to spam, or to infringe others' rights.

Kia assistants answer questions and perform actions based on your studio's data and settings. AI output can be wrong: you are responsible for reviewing important AI-generated content (quotes, contract language, client messages) before relying on it.

Public-facing Kia assistants speak for your studio only within the knowledge and settings you approve. You are responsible for what you choose to publish to your customers.

You may not use AI features to generate unlawful, deceptive, or harmful content, or to attempt to access another studio's data.

You may connect third-party services (such as Google Calendar). Your use of those services is governed by their own terms and privacy policies. We access connected services only as needed to provide the feature you enabled, and you can disconnect them at any time.

Paid plans are billed in advance on a recurring basis through our payment provider. Prices are shown at checkout and may change with notice before your next billing period.

You can cancel at any time; your plan remains active until the end of the paid period. Fees already paid are non-refundable except where required by law.

Failed payments may result in suspension of paid features after notice.

You may not: probe or disrupt the service or its security; access another studio's data; reverse engineer the service except as permitted by law; resell the service without our written consent; or use the service in violation of any law.

We may suspend or terminate accounts that violate these Terms, with notice where practicable.

Picture Day OS, its design, and its software are owned by us and protected by intellectual property laws. These Terms give you a limited, non-exclusive, non-transferable right to use the service while your account is in good standing.

Feedback you send us may be used to improve the service without obligation to you.

The service is provided “as is” and “as available”. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted or error-free.

To the fullest extent permitted by law, our total liability for any claim arising from the service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, special, or consequential damages, or for lost profits or lost data.

Nothing in these Terms excludes liability that cannot be excluded by law.

You may close your account at any time. We may terminate or suspend access for breach of these Terms or to protect the service and other users.

On termination, your right to use the service ends. Data deletion follows our Privacy Policy.

We may update these Terms from time to time. We will post the updated version on this page and update the “last updated” date; material changes will be announced in the app or by email. Continued use after the effective date means you accept the updated Terms.
